1. Acceptance of these Terms

These Terms and Conditions govern your participation in the Accelerate Management School Ambassador Programme.

By selecting “I have read and agree to the Terms & Conditions” during the Ambassador registration process and submitting your application, you confirm that you have read, understood and agree to be legally bound by these Terms and Conditions.

Your acceptance becomes effective immediately upon submission of your Ambassador application.

If you do not agree to these Terms and Conditions, you may not participate in the Programme.

2. Independent Ambassador Status

As an Ambassador, you participate in the Programme as an independent contractor.

Nothing contained in these Terms and Conditions creates an employment relationship, partnership, joint venture, agency or franchise relationship between you and Accelerate Management School.

As an independent Ambassador:

• You decide when, where and how you promote Accelerate.
• You are not entitled to employee benefits, including leave, bonuses, retirement benefits, medical aid or unemployment insurance.
• You are responsible for your own tax affairs and any statutory obligations relating to your commission earnings.
• You may not represent yourself as an employee, manager, director or authorised representative of Accelerate Management School.
• You may not enter into agreements or make commitments on behalf of Accelerate Management School unless authorised in writing.

Participation in the Programme is voluntary and commissions are earned only in accordance with these Terms and Conditions.

3. Responsibilities of the Ambassador

As an Ambassador you agree to:

• Promote Accelerate honestly, professionally and ethically.
• Use only official Accelerate marketing materials.
• Share only your unique Ambassador Link with prospective students.
• Provide accurate information regarding Accelerate’s courses and promotions.
• Protect the reputation of Accelerate Management School.
• Comply with all applicable South African laws.

4. Responsibilities of Accelerate

Accelerate Management School agrees to:

• Provide you with a unique Ambassador Link.
• Supply official marketing materials and training resources.
• Track registrations completed through your Ambassador Link.
• Track successful monthly debit order collections.
• Pay commissions in accordance with these Terms and Conditions.
• Provide access to the Ambassador Portal.

5. Your Ambassador Link

Every Ambassador receives a unique Ambassador Link.

Any student who registers using your Ambassador Link will automatically be allocated to your Ambassador account.

Students referred through your Ambassador Link remain assigned to your account unless Accelerate determines that fraud, abuse or a breach of these Terms has occurred.

Students may register:

• By completing the registration themselves.
• With your assistance in person.
• With your assistance over the telephone.

Provided your unique Ambassador Link is used, the student will always be linked to your Ambassador account.

6. Commission Structure

The current commission payable is:

• R100 for every successful monthly debit order collection received from each referred student.

Commission is payable only on successful monthly debit order collections.

No commission is payable where:

• A debit order fails.
• A debit order is reversed.
• A payment is cancelled.
• A student defaults.
• A registration is cancelled.
• A registration is fraudulent.

Accelerate Management School reserves the right to amend the commission structure upon reasonable notice to Ambassadors.

7. Commission Payments

Commission payments will be made on the fifth (5th) working day of the month following successful debit order collections.

Only successful debit order collections qualify for payment.

Accelerate reserves the right to reverse or recover commissions paid in error or resulting from fraudulent or invalid registrations.

8. Student Payments

Ambassadors may not:

• Accept cash from students.
• Accept EFT payments.
• Accept card payments.
• Accept any payment whatsoever from students.
• Charge administration fees.
• Charge consultation fees.
• Charge any additional fee.

All student payments must be processed exclusively through the official Accelerate registration system using the approved debit order process and official published pricing.

9. Marketing & Conduct

Ambassadors agree to market Accelerate honestly and professionally.

Ambassadors may not:

• Misrepresent Accelerate or its courses.
• Make false or misleading statements.
• Make guarantees or promises not authorised by Accelerate.
• Alter official pricing.
• Create unauthorised promotions.
• Use unofficial marketing materials.
• Damage the reputation of Accelerate.

10. Confidentiality & POPIA

Ambassadors agree to keep confidential all non-public business and student information obtained through the Programme.

Ambassadors must comply with the Protection of Personal Information Act (POPIA) and may only collect or submit student information with the student’s knowledge and consent.

11. Intellectual Property

All trademarks, logos, branding, graphics, videos, marketing materials, training content and other intellectual property remain the exclusive property of Accelerate Management School.

Ambassadors are granted a limited, non-exclusive, non-transferable licence to use these materials solely for promoting Accelerate while participating in the Programme.

No material may be copied, modified or used for any other purpose without prior written permission.

12. Duration

These Terms and Conditions commence when your Ambassador application is approved and continue until terminated by either party.

You may terminate your participation at any time by notifying Accelerate Management School in writing.

13. Suspension & Termination

Accelerate may suspend or terminate your participation immediately if you:

• Breach these Terms and Conditions.
• Misrepresent Accelerate.
• Commit fraud.
• Act dishonestly or unethically.
• Collect money directly from students.
• Charge unauthorised fees.
• Submit fraudulent registrations.
• Damage the reputation of Accelerate.
• Breach any applicable law.

Upon termination:

• Your Ambassador Link may be deactivated.
• Access to the Ambassador Portal may be removed.
• You must immediately stop using all Accelerate branding and marketing materials.
• Commissions earned on successful debit order collections before termination will remain payable.
• No future commissions will accrue after termination unless Accelerate agrees otherwise in writing.

14. Changes to the Programme

Accelerate Management School reserves the right to amend:

• Commission structures.
• Programme rules.
• Marketing materials.
• Promotions.
• Payment dates.
• These Terms and Conditions.

Where practical, Accelerate will provide reasonable notice of material changes.

15. Limitation of Liability

Participation in the Ambassador Programme is voluntary.

Accelerate Management School does not guarantee any level of income or commission.

Your earnings depend entirely on successful student registrations and successful monthly debit order collections.

Accelerate Management School shall not be liable for any indirect, incidental or consequential loss arising from participation in the Programme.

16. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

17. Entire Agreement

These Terms and Conditions constitute the entire agreement between Accelerate Management School and the Ambassador regarding participation in the Ambassador Programme and supersede any previous verbal or written discussions, representations or agreements relating to the Programme.

18. Electronic Acceptance

By selecting “I have read and agree to the Terms & Conditions” and submitting your Ambassador application, you acknowledge that you have read, understood and accepted these Terms and Conditions.

You agree that your electronic acceptance constitutes a legally binding agreement and has the same force and effect as a handwritten signature.
